DRC: The Innovations of the Amended Mining Code

The development of the mining sector in the Democratic Republic of Congo (DRC), which was anticipated through the adoption of the 2002 Mining Code to bring back substantial revenues to the State for its economic and social growth, has not produced the expected results. The revision of the former mining Code is therefore motivated by the following reasons:-              To increase the level of control over the management of the State's mining sector and mining titles;-              To balance the tax, customs and exchange rate regime;-              To focus on the social and environmental responsibility of mining companies; and-              To bring the mining legislation in line with the evolution of the politico-administrative context, including the introduction of new ministerial departments in the mining sector.
