Libya: Research Consultant on Housing, Land, and Property issues

The Norwegian Refugee Council (NRC) is a non-governmental, humanitarian organization with 60 years of experience in helping to create a safer and more dignified life for refugees and internally displaced people. NRC advocates for the rights of displaced populations and offers assistance within the shelter, education, emergency food security, legal assistance, and water, sanitation and hygiene sectors.

The Norwegian Refugee Council has approximately 5000 committed and competent employees involved in projects across four continents. In addition, NRC runs one of the world's largest standby rosters -NORCAP, with 650 professionals, ready to be deployed on 72 hours notice when a crisis occurs.

BACKGROUND

Following the Libyan uprising in 2011, which led to the overthrow of long-time leader Muammar Gadaffi, UNHCR commissioned an extensive research report on ‘Housing, Land and Property (HLP) Issues and the Response to Displacement in Libya’.  The report covered domestic laws and international obligations owed by Libya on HLP rights.  It also looked at the situation of certain groups of IDPs as well as other refugees and non-citizens who had been displaced and/or affected by HLP violations within Libya.  The report concluded with various issues and recommendations related to legal and humanitarian support to displaced persons.  Research for the report was conducted through field visits in 2012. 

Considering the changes that have taken place within Libya since that time, including the ongoing conflict, protracted displacement and political uncertainty, UNHCR require the report to be updated to take account of developments since 2012.

Updated information on HLP in Libya is also necessary for the work of several Sectors and Working Groups in the Libya response, including the Mixed Migration, Protection and Shelter, who require clear, practical and reliable guidance for due diligence in their programming work. 

OBJECTIVES

NRC is seeking a consultant to conduct a comprehensive review of the 2012 report and to draft HLP due diligence guidelines for the Libyan Shelter Sector.

UNHCR report

The report should cover the following matters:

  • Review any relevant domestic legislative changes and policy developments that have taken place since 2012 with relevance to HLP rights,
  • Update the political contextual parts of the report to reflect political developments and changes since 2012,
  • Conduct field missions to Libya to meet with key stakeholders and follow up on the earlier field visits conducted in 2012,
  • Conduct an assessment of groups of displaced persons including IDPs, refugees, non-citizens and others affected by HLP violations in Libya, including follow-up on the three groups identified as vulnerable in the initial report with an additional focus on Syrian displaced communities in Libya,
  • Incorporate any relevant developments on international HLP standards and international HLP obligations owed by Libya,
  • Review and update the humanitarian needs and stakeholder recommendations part of the report,
  • Review and update the report Annexes,
  • Ensure the report is comprehensive, up to date, accurate and provides a clear overview of the current status of HLP rights and displacement in Libya,
  • Provide recommendations to inform HLP programming in Libya

Due Diligence Guidelines

The Due Diligence Guidelines should cover the following issues:

  • General due diligence requirements for building and reconstruction in Libya
  • Phase-specific requirements including mapping of local HLP actors, community consultations, beneficiary selection, verification, monitoring and evaluation
  • Intervention specific requirements
  • Key HLP issues in Libya

The consultant will be provided with other similar due diligence guidance notes issued by other Shelter Sectors for reference.

OUTPUTS

  • Inception report, setting out the legal and field research methodology and workplan for review of the initial report
  • Draft report for review by NRC and UNHCR
  • Final report, taking account of comments from NRC, UNHCR and other relevant stakeholders
  • Presentation of final report to key stakeholders
  • Preparation of Shelter Due Diligence Guidelines for Libya
  • Training workshop for Shelter actors on Due Diligence Guidelines (1 day)

TIMETABLE

  • 15 September to 31 December (4 months)

REQUIRED COMPETENCIES/SKILLS

  • Master's degree in law, politics or relevant area of study
  • Extensive experience in legal and field research with published research
  • Strong background in HLP rights
  • Good data analysis skills
  • Ability to communicate clearly and concisely both verbally and in written form
  • Good coordination skills
  • Good people skills / inter-personal skills / ability to engage with a wide variety of actors
  • Fluency in English for oral and written. 
  • Knowledge of the political situation in Libya an advantage
